Terms and Conditions for Voucher Participants - Discount on Movie Tickets
These Terms and Conditions (the "Agreement") govern the relationship between Newton Cinema Private Limited (hereinafter referred to as the "Company"), and voucher participants (hereinafter referred to as the “User” or "Users") availing referral based discounts on movie tickets (hereinafter referred to as the "Program") through influencer platform www.tortil.com (hereinafter referred to as the “Platform”). By participating in the Program, Users agree to comply with these Terms and Conditions.
Participation
Eligibility for Voucher Use
The user must be at least 18 years of age (as of 1st June 2024).
The user must be a citizen or resident of India.
Participation in the Program is voluntary and does not create any employment or agency relationship between the User and the Company.
Users must book the movie ticket using the discount voucher (promo code) on BookMyShow or PayTM by 30th of June, 2024 6 pm IST. Bookings can be made to watch the movie in any theatre in India by Sunday, 30th of June, 2024.
Eligibility for the Giveaway Offer (Lucky Draw
All Users who generate a voucher code on the Platform and redeems it while purchasing tickets to watch the movie “Paradise” in theaters in India during the raffle period are automatically enrolled in the lucky draw.
The User should be willing to travel to Sri Lanka if selected as a winner.
The winner must have or procure a valid Indian passport for self and the travel partner, and must comply with entry formalities enforced by the Government of Sri Lanka.
The winner must bear the Visa fee and any associated cost for self and the travel partner. Airline round trip and hotel accommodation costs will be borne by the Company.
As per Section 115bb, the winner must pay 30% plus applicable surcharge and cess (31.2%).
The Company reserves right to request valid proof of identity, residency, age and other relevant documentation and may disqualify participants at any point if the Company at its sole discretion determines that the provided proof is not sufficient, inaccurate or if the participant fails to provide any documents required by the Company or upon failure to sign and return any declaration, affidavit.
Participants Acknowledge that for generating the voucher code, your personal information namely your name, phone, email address, date of birth, gender, mailing address and movie preferences are being collected by the Company and you hereby provide your consent for the same. Any User who is unwilling to provide such consent may refrain from using the Platform. Your participation shall be deemed as consent. Participants acknowledge and understand that by participating in the lucky draw, their information and material including personal information may be used by the Company and that the participant and his/her family members and friends may be photographed, interviewed and video recorded and they agree to permit the Company to be granted a perpetual right to use the same as publicity and to sign an affidavit and to procure a signed affidavit from their family members and friends to this extent in the event the Company deems it necessary. Any such material/footage will be the sole property of the Company which has the right to use, edit, adapt, post, stream, copy and exploit such material/footage and all elements embodied therein, including any names and likenesses embodied therein, in whole or in part, in any and all media now known or hereafter devised throughout the world, for the fullest extent permitted by applicable law, for advertising, promotional, trade and other purposes. The Company shall not use or share the personal information of any user to a third party other than for the purpose which is stated above.
The Company may, without notice and at any time in its sole option, disqualify any participant who:
does not meet the lucky draw’s eligibility criteria,
fails to comply with these terms and conditions,
attempts to register or participate in the lucky draw in any manner or through any means other than as described in these terms and conditions,
attempts to disrupt or undermine the lucky draw or attempts to circumvent any of these terms and conditions,
acts in a manner that would bring disrepute to the Company, its affiliates and/or any partner of the lucky draw, or
in the sole opinion of the Company is found to be of bad faith, have a prior criminal record or involvement in any crime, offense or fraudulent conduct whether resulting in a conviction or not.
Discount Voucher
Users can avail a ticket voucher for a specific movie when they visit the Platform through a designated referral link.
The value of the voucher shall be a flat ₹50 that can be discounted from the total ticket sale amount while making the ticket purchase online. The voucher redemption process is detailed in the section below.
3. Voucher Redemption Process
The user must visit the Platform through the referral link in order to get the voucher.
The referred user must generate a voucher code on the Platform and redeem it while booking the ticket on a ticketing partner website in order to avail the discount benefit.
If the referred user does not generate the voucher code in the Platform or does not use it during checkout on the ticketing website, the offer will be missed.
A user can avail the voucher offer only once during the Program period for the film.
Successful ticket purchase and voucher redemption will be confirmed by the Platform.
Offer Tracking
The Influencer will post a unique referral link for a specific movie on social media to generate visits to the Platform.
The User must visit the Platform through a referral link in order to qualify for the voucher offer.
The Platform will ensure that the User is registered, identified and is mapped to the influencer referral and any voucher code generated.
The Platform will partner with the ticketing platforms to track the voucher redemption and ticket purchase status of the Users.
Compliance
Users must comply with all applicable laws, regulations, and guidelines, including those related to online conduct.
Users are responsible for ensuring that any content posted in connection with the Program is accurate, truthful, and does not violate the rights of any third party.
Representations and Warranties
Users represent and warrant that by participating the lucky draw:
They may satisfy all eligibility requirements for participants.
They shall all times be in compliance with all applicable laws and regulations;
The Company’s use of your information and material will not infringe or violate any laws, third party intellectual property, privacy or other rights.
That they shall abide by any supplier terms and conditions that may be applicable to the holiday packages made available.
Lucky Draw Breakdown and Raffle Prizes
In order for a participant to be declared a winner such participant must be eligible for the prize as the winner of the lucky draw, he, she or they must have complied with, and remain in compliance with, these Terms and Conditions
Judging Criteria
Closing date for enrollment will be 8th July 2024.
All winners to be announced by the 18th July 2024.
The winners will be selected by a panel of judges appointed by the Company.
Such a decision shall be final and binding and not be open to challenge or appeal.
The winners will be announced on the Company’s and Platform’s Social Media pages (i.e. Facebook, Instagram and Twitter).
The winners will be notified via an official email from the Company followed by a phone call. If the winner cannot be contacted for whatsoever reason or does not claim the prize within 7 days of a notification, the Company reserves the right to withdraw the prize from the winner and award the prize to another participant as decided by the Judges.
Whilst the Company shall use its best endeavors to meet these timelines, it shall have absolute discretion to change the same as it deems fit and appropriate with or without notice to the participants.
Travel Time Frame
The Company will advise the travel window along with travel conditions.
Cancellation
The Company reserves the right to cancel or amend the lucky draw and these terms and conditions without notice for whatsoever reason whether for reasons within the control of the Company or beyond its control such as in the event of a catastrophe, war, civil or military disturbance, unexplainable phenomenon or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Company’s control. Any changes to the lucky draw will be notified to entrants via the website and email.
Disclaimer and Limitation of Liability
By entering this lucky draw, the participant is indicating his/her agreement to be bound by these terms and conditions. The Company shall not under any circumstance be liable to indemnify and /or hold harmless you, your partner or any person claiming under, for on behalf of you in respect of any loss or damage suffered as a result of your applying to participate in the lucky draw, whether direct, indirect, consequential or otherwise.
Termination
The Company reserves the right to terminate an User's participation in the Program at any time and for any reason, including but not limited to violation of these Terms and Conditions, fraudulent activity, or inappropriate conduct.
Upon termination, any voucher code claimed or lucky draw enrolled by the User will be forfeited.
Confidentiality
Users may have access to confidential information about the Company, its products, or the Program. Users agree to keep such information confidential and not disclose it to third parties without the Company's prior written consent.
Amendments
The Company reserves the right to amend or modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on the Company's website or notification to Users.
By participating in the Program, Users acknowledge that they have read, understood, and agreed to abide by these Terms and Conditions. Failure to comply with these Terms and Conditions may result in the termination of a User's participation in the Program and forfeiture of any voucher benefits earned.
